Competency hearing scheduled for Mason City man accused of sexual abuse

MASON CITY — A hearing has been scheduled after the attorney for a homeless Mason City man charged with sexual abuse questions whether his client is competent to stand trial.

37-year-old Darryl Green was charged with third-degree sexual abuse after being accused of going into a room at a home in the 400 block of 1st Street Northwest in the early morning hours of January 7th and performing a sexual act against the will of a female resident.

Green was scheduled to be arraigned on Monday, but his attorney Timothy Cullen filed a motion questioning Green’s competency, saying that he recently went to the Cerro Gordo County Jail to see if Green wanted to execute a written arraignment, but upon arriving was informed by the jail regarding concerns about Green’s competency.

District Judge Chris Foy has scheduled a hearing for March 4th in Cerro Gordo County District Court to decide whether probable cause exists to believe Green suffers from a mental disorder which prevents him from appreciating the charge against him, understanding the proceedings, or assisting effectively in his defense.
