Competency evaluation ordered for Mason City man accused of sexual abuse

MASON CITY — A competency evaluation has been ordered for a homeless Mason City man charged with sexual abuse.
37-year-old Darryl Green was charged with third-degree sexual abuse after being accused of going into a room at a home in the 400 block of 1st Street Northwest in the early morning hours of January 7th and performing a sexual act against the will of a female resident.
Green was scheduled to be arraigned last week, but his attorney Timothy Cullen filed a motion questioning Green’s competency, saying that he recently went to the Cerro Gordo County Jail to see if Green wanted to execute a written arraignment, but upon arriving was informed by the jail regarding concerns about Green’s competency.
Prior to a scheduled hearing this week, prosecutors filed notice that they would not resist Green’s request.
After a review, District Judge Chris Foy has ruled that there is probable cause to believe Green suffers from a mental disorder which prevents him from appreciating the charge he faces, understanding the proceedings, or assisting effectively in his own defense. Foy ordered that Green undergo an evaluation by the state psychiatrist at the Iowa Medical and Classification Center to determine his competency.
