Homeless Mason City man charged with sexual abuse ruled not competent to stand trial

MASON CITY — A homeless Mason City man charged with sexual abuse has been ruled as not competent to stand trial. 

37-year-old Darryl Green was charged with third-degree sexual abuse after being accused of going into a room at a home in the 400 block of 1st Street Northwest in the early morning hours of January 7th and performing a sexual act against the will of a female resident.

Green’s attorney Timothy Cullen in March filed a motion questioning Green’s competency, saying that he went to the Cerro Gordo County Jail prior to Green’s scheduled arraignment hearing in late February to see if Green wanted to execute a written arraignment, but upon arriving was informed by the jail regarding concerns about Green’s competency.

District Judge Chris Foy in March ruled there was probable cause and ordered that Green undergo an evaluation at the Iowa Medical and Classification Center to determine his competency.

During a hearing held on Monday in Cerro Gordo County District Court, District Judge Rustin Davenport ruled that Green was suffering from a mental disorder, preventing him from appreciating the charge, understanding the proceedings or assisting effectively in his defense.

Davenport ordered that Green be returned to the Iowa Medical and Classification Center or other appropriate facility for treatment designed to restore his competency.
