Mistrial declared in St. Ansgar man’s sexual abuse trial

OSAGE — A mistrial has been declared in the sexual abuse trial of a St. Ansgar man.

34-year-old Zachery Orlovsky was charged with second-degree sexual abuse after he allegedly forcibly assaulted a woman at his home on October 14th 2023.

Orlovsky’s trial started on July 16th in Mitchell County District Court with a jury being sworn in the next day. After the trial started, Orlovsky’s attorney made a motion to request a competency evaluation due to Orlovsky’s choice to take extra prescription medication. Orlovsky stated he had approval of his treating practitioner to do so, his attorney felt he struggled to assist counsel.

The court found there was probable cause Orlovsky was suffering a mental disorder and suspended proceedings pending the completion of a competency evaluation.

District Judge Gregg Rosenbladt has re-set the trial to start on September 24th pending the results of the evaluation.
